Access to the Website by minors is prohibited. 4.- INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The provider is the owner or, where applicable, holds the corresponding licenses over the intellectual and industrial property exploitation rights of the Website, as well as all content offered therein, including the platform itself, texts, photographs or illustrations, logos, trademarks, graphics, designs, interfaces, or any other information or content, and the services available through it.

In no case shall it be understood that accessing, browsing, and using the Website by the user implies a waiver, transfer, license, or total or partial assignment of these rights by the provider. The user has a right to use the content and/or services of the Website strictly for domestic purposes and only to enjoy the services in accordance with these Terms of Use.

References to registered trademarks or trade names, or other distinctive signs, whether owned by the provider or third-party companies, implicitly prohibit their use without the consent of the provider or their legitimate owners. Under no circumstances, unless expressly stated otherwise, does access, browsing, or use of the Website and/or its content grant the user any rights over the distinctive signs included therein.

All intellectual and industrial property rights over the content and/or services of the Website are reserved. In particular, it is prohibited to modify, copy, reproduce, publicly communicate, transform, or distribute, by any means and in any form, all or part of the content included on the Website for public or commercial purposes, without prior express written authorization from the provider or, where applicable, from the rights holder.

Likewise, it is prohibited to remove or manipulate copyright notices or other credits identifying the content rights holders that the user may find on the Website, as well as technical protection devices, digital fingerprints, or any protective mechanism or information incorporated into the content offered on the Website.

If the user submits any information to the provider through any of the channels made available for this purpose, the user declares, guarantees, and accepts that they have the right to do so freely, that such information does not infringe any intellectual property, industrial property, trade secret, or other third-party rights, and that such information is not confidential or harmful to third parties.

The user acknowledges that they assume responsibility, holding the provider harmless for any communication they provide personally or on their behalf, including the accuracy, legality, originality, and ownership of the same.

If the user becomes aware of any illegal content, content contrary to laws, or content that may constitute an infringement of intellectual and/or industrial property rights, they must immediately notify the provider via the email address gestion@berzeus.com so that appropriate measures can be taken.

Similarly, if any user or third party considers that any content on the Website owned by the provider infringes their intellectual and/or industrial property rights, or any other rights, they must send a communication to BERZEUS S.L, Calle Arturo Soria 91, 28027 Madrid, including the following information:

  • Documentation proving ownership of the rights allegedly infringed.
  • Detailed account of the rights allegedly infringed by the provider and their exact location on the Website.
  • Express declaration from the complainant that the use of the content has been carried out without the consent of the rights holder.

5.- LINKS

5.1. LINKS TO OTHER WEBSITES
If the Website displays links to other websites via buttons, links, banners, or embedded content, the provider informs that these are directly managed by third parties, and the provider has neither the human nor technical means to know in advance and/or control and/or approve all the information, content, products, or services provided by other platforms linked from the Website.

Consequently, the provider cannot assume any responsibility for any aspect related to the platform or website linked from the Website, specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links, and/or any of its content in general.

If users become aware that activities carried out through these third-party websites are illegal or contrary to morality and/or public order, they must immediately notify the provider so that the access link can be disabled as soon as possible.

In any case, the establishment of any type of link from the Website to another external website does not imply any relationship, collaboration, or dependency between the provider and the operator of the external website.

5.2. LINKS TO THE PROVIDER’S CHANNEL ON OTHER PLATFORMS AND SOCIAL NETWORKS
The provider makes available to users, through various tools and applications, link means that allow users to access the channels and pages the provider maintains on different platforms and social networks owned and/or managed by third parties (e.g., Facebook, Twitter, LinkedIn, Google+, etc.). The inclusion of these links on the Website is solely to facilitate user access to these channels on the different platforms and social networks.

The establishment of these applications does not imply any relationship between the provider and the owner, manufacturer, or distributor of the linked platform, nor does it imply acceptance or approval by the provider of its content and/or services, the owner, manufacturer, or distributor being solely responsible.

Under no circumstances does the provider share any private information about its users with Facebook, Twitter, or any other social network that may be incorporated in the future; its sole purpose is that established in these Terms of Use and the Website Privacy Policy. Any information that the user provides to these platforms will be at their own risk, without provider involvement.

Activating and using these applications may require user identification and authentication (login/password) on the corresponding platforms, entirely external to the Website and outside the provider’s control. By accessing these external networks, the user enters an environment not controlled by the provider, so the provider will not be responsible for the security configuration of these environments.

Since the provider has no control over the content hosted on these channels, the user acknowledges and accepts that the provider assumes no responsibility for the content or services the user may access on these pages, nor for any content, products, services, advertising, or other material available on them. Therefore, the user must exercise caution when evaluating and using the information, content, and services available on linked channels, and regarding any information from themselves or third parties they wish to share on these channels.

5.3. LINKS FROM OTHER WEBSITES TO THE WEBSITE
The provider does not authorize links to the Website from pages containing illegal, illicit, degrading, obscene material, or generally contrary to law, morality, public order, or generally accepted social norms.

Users may establish links on their websites that direct to the Website provided that the following conditions are met: a) the link may not reproduce the Website content or parts of it in any way; b) it is not allowed to create a browser or border environment on the Website sections, nor may the Website be modified in any other way; c) false or inaccurate statements or indications about the Website are not permitted, nor may it be declared or implied that the provider has authorized the link or supervised or assumed in any way the content or services made available on the page establishing the link; d) the webpage linking to the Website must not contain illegal information or content, content contrary to generally accepted morality and good conduct, or contrary to any third-party rights, including intellectual and industrial property rights and/or the right to honor, privacy, personal or family image, or any other right, nor content contrary to data protection regulations.

The provider has no human or technical means to know, control, or approve all information, content, products, or services provided by other websites that have links to the Website. The provider assumes no responsibility for any aspect of the website linking to the Website, specifically, but not limited to, its operation, access, data, information, files, quality, and reliability of its products and services, its own links, and/or any of its content in general.

6.- WEBSITE USAGE RULES

Accessing or using the Website for illegal or unauthorized purposes, with or without economic gain, is prohibited, and the consequences will be the sole responsibility of the user. In particular, and without limiting the following list:

  • Using the Website to collect personal data from other users;
  • Using the Website illegally, against good faith, morality, or public order;
  • Registering through the Website with a false identity, impersonating others, or using a profile or taking any action that may mislead other users about the origin of a message;
  • Unauthorized access to any section of the Website, other systems, or networks connected to the Website, to any provider server, or to the services offered via the Website, through hacking, password extraction, or any other illegitimate means;
  • Breaching, or attempting to breach, security or authentication measures of the Website or any connected network, or security/protection measures inherent to the content offered on the Website;
  • Performing any action that causes disproportionate or unnecessary saturation in the Website infrastructure or in the provider’s systems or networks, or in systems and networks connected to the Website;
  • Preventing the normal development of an event, contest, promotion, or any other activity available via the Website or any functionality, whether by altering or attempting to alter, illegally or otherwise, access, participation, or operation, or falsifying results, and/or using fraudulent participation methods through any procedure or practice that violates these Terms of Use.

Failure to comply with the above obligations may lead the provider to take appropriate measures under the law and exercise its rights and obligations, including deletion or blocking of the offending user’s account, without any possibility of compensation for damages.

Likewise, the Website has areas where users can participate, publish content, and/or share content, whether their own or published by the provider. These areas may belong to the provider and be controlled by it, or be independent social networks not managed by the provider, for which the provider cannot be held responsible for proper functioning or conditions/policies; the user must always consent to and assume responsibility for information processing in these platforms.

In any case, when the user participates in any of these areas, other users may access and use all content published by the user. The provider cannot control how others use such content and is therefore not responsible. The provider recommends not publishing personal data or materials protected by intellectual property or other rights.

To ensure the Website is a safe environment and to protect users, publishing content that:

  • Violates fundamental rights to honor, privacy, or image, especially of minors;
  • Includes images or personal data of third parties without consent;
  • Violates communication secrecy, intellectual property, or data protection laws;
  • Contains illegal, racist, obscene, pornographic, abusive, defamatory, misleading, or fraudulent material;
  • Contains spam or links to unrelated sites;
  • Includes advertising or commercial communications for promotional purposes or data collection;

Users who violate these prohibitions are responsible for any claims arising. Even if no third-party claims arise, the provider may block access or participation for users violating these conditions.

7.- RESPONSIBILITIES AND GUARANTEES

The provider cannot guarantee the reliability, usefulness, or truthfulness of all information and/or services on the Website, nor of the usefulness or truthfulness of documentation made available through it.

Consequently, the provider does not guarantee or is responsible for: (i) continuity of Website content; (ii) absence of errors in content; (iii) absence of viruses or harmful components on the Website or server; (iv) invulnerability of the Website or impossibility of breaching security measures; (v) lack of utility or performance of content; (vi) damages caused to oneself or third parties by users violating these terms or breaching security measures.

The provider declares that it has taken all necessary measures, within its capabilities and technological state, to ensure Website operation and minimize system errors and content mistakes.

The provider does not guarantee the legality, reliability, or usefulness of third-party content. Users must notify the provider of any illegal content or possible infringement of third-party rights immediately.

The provider reserves the right to suspend, modify, restrict, or interrupt access, browsing, use, hosting, and/or downloading of content and/or services, temporarily or permanently, with or without notice, for users violating any provisions of these Terms of Use, without compensation.

8.- WEBSITE SUSPENSION

The provider reserves the right to suspend, modify, restrict, or interrupt access, browsing, use, hosting, and/or downloading of content and/or services, temporarily or permanently, with or without notice, for users violating any provisions of these Terms of Use, without compensation.

9.- GENERAL PROVISIONS

Headings of clauses are for reference only and do not affect interpretation. The provider may modify these terms wholly or partially, publishing changes in the same manner or via communication to users.

The duration of these Terms coincides with their publication until modified, at which point the modified terms take effect.

Regardless of any specific conditions, the provider may terminate, suspend, or interrupt access to Website content at any time without notice and without compensation. After termination, prohibited uses remain in effect.

If the user violates these Terms, the provider may suspend or cancel their profile automatically without notice, without compensation. The provider may notify and collaborate with authorities if it detects legal violations or suspects crimes.

Payment for products/services offered by the provider will be governed by the general and/or specific terms of each service. In case of conflict, specific service conditions prevail.

If any provision is declared null or unenforceable by a competent court or authority, it does not affect the remaining provisions.

Failure by the provider to enforce any right or provision does not constitute a waiver unless expressly recognized in writing.

10.- APPLICABLE LAW AND JURISDICTION

Where applicable law allows parties to submit to a specific jurisdiction, Spanish law shall apply to disputes arising from or related to the Website, and the parties submit to the Courts and Tribunals of Madrid, and, if applicable, to Consumer Arbitration Tribunals or equivalent.
